1. Acceptance of Terms

By accessing or using the CyberReady platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

CyberReady provides an AI-assisted documentation generation service designed to help businesses prepare cyber insurance documentation. The Service produces policies, procedures, and supporting documents based on answers supplied by the customer during a security questionnaire. CyberReady is a documentation-as-a-service provider and does not provide legal, insurance, or compliance advice.

3. AI-Generated Content Disclaimer

All documents produced by the Service are generated using artificial intelligence based on the answers you supply during the questionnaire. The Service is automated and uses large language models that are subject to error, including factual inaccuracies, omissions, and outputs that diverge from your stated environment (commonly referred to as “hallucinations”).

No document produced by the Service has been reviewed by a solicitor, qualified insurance broker, or independent compliance professional prior to delivery. Documents are subjected to automated quality checks that screen for placeholder text, missing sections, and suspiciously short outputs, but those checks are mechanical and do not constitute professional review.

You are solely responsible for: (i) verifying the accuracy of the answers you provided; (ii) reviewing each generated document before relying on it; (iii) arranging review by a qualified person — your insurance broker, IT lead, or a contracted reviewer — before submitting any document to a carrier or regulator; and (iv) re-generating or amending documents if your environment, controls, or business circumstances change after the questionnaire was completed.

Nothing in this section limits the disclaimers expressed elsewhere in these Terms, including Section 4 (No Warranty on Insurance Outcomes), Section 5 (Customer Attestation Requirement), or Section 7 (Limitation of Liability).

4. No Warranty on Insurance Outcomes

CyberReady makes no representation or warranty, express or implied, that any document produced by the Service will be accepted by any insurance carrier, satisfy any regulatory requirement, or result in the payment of any insurance claim. Use of the Service does not constitute an endorsement or approval by any insurer.

5. Customer Attestation Requirement

Before downloading your package, you are required to confirm that the answers you provided during the questionnaire are accurate to the best of your knowledge, and that you commit to implementing the controls described in the resulting documents. Providing inaccurate information may render the documents unsuitable for their intended purpose and may constitute misrepresentation to your insurer.

6. Payment and No-Refund Policy

All fees are charged at the point of checkout and are non-refundable except as described in our Refund Policy. Payment is processed securely via Stripe. By completing checkout, you acknowledge that generation of your document package commences immediately upon payment and that you forfeit any right of withdrawal under applicable consumer distance-selling regulations.

7. Limitation of Liability

To the fullest extent permitted by law, CyberReady Limited's aggregate liability to you for any and all claims arising under or in connection with these Terms or the Service — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the amount you paid to CyberReady for the Service in the twelve (12) months preceding the event giving rise to the claim.

CyberReady shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation: lost profits or revenue; lost or rejected insurance claims; insurance premium increases; loss of business opportunity; loss or corruption of data; reputational harm; or the cost of substitute services or documentation. This exclusion applies whether or not CyberReady has been advised of the possibility of such damages and even if a remedy specified in these Terms fails of its essential purpose.

Nothing in this Section 7 excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability which cannot be excluded or limited under the laws of England and Wales, including under the Consumer Rights Act 2015 where it applies. To the extent the Service is supplied to a consumer, statutory consumer rights are unaffected.

You acknowledge that the price paid for the Service reflects the allocation of risk established in this Section 7 and that, without this allocation, CyberReady would not be able to offer the Service at the price charged.

The provisions of this Section 7 shall survive termination or expiration of these Terms.

8. Indemnification

You agree to indemnify and hold harmless CyberReady Limited and its officers, directors, employees, and agents from any claim, loss, damage, or expense (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your submission of inaccurate information during the questionnaire process.

9. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use the Service to generate documents for fraudulent purposes or to misrepresent your organisation's security posture to any third party.

10. Governing Law (England & Wales)

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
